ITC 337 investigation case proceeding into the filing of Summary Determination Motion

After the expert paid a site visit to the respondent’s manufacturing plant in Yancheng city two weeks ago, the expert has prepared an expert report demonstrating the non-infringement of the new process protocol.  US lawyers of WSGR then submitted to ITC two summary determination motions in which one is respondent motion for summary determination of non-infringement of the patent, the other one is respondent motion for summary determination of invalidity of the patent based on prior art.  Both motions restate the differences of respondent’s process protocol and the plaintiff’s patent.
