Wendong Dai, Partner at JC Master, as a representative attended the Training Conference for the Issuance System of the Growth Enterprise Board (GEB) held on July 14, which was organized by China Securities Regulatory Commission (CSRC).

 

According to messages disclosed from the conference, CSRC will enable enterprise to apply for listing after releasing a series of documents about application for GEB offerings and listings. The acceptance of enterprises’ application materials for listings will be scheduled from late July to early August. In accordance with the listing procedure, the examination and approval by CSRC will take two or three months. Upon approval, enterprises will take about two weeks for enquiry and subscription. At the end of October or the beginning of November, the first group of GEB enterprises will be listed.

 

Regarding the the transfer of application for listing from Main Board to GEB, an official of CSRC replied as follows: “The enterprises waiting for listing at the Main Board have no priorities for application for listing at GEB. Such enterprises shall amend their application materials in accordance with the requirements of GEB and go through necessary procedures.”

 

 

Recently, the first-instance judgment on a dispute case resulted from corporate restructuring was rendered. The client of JC Master won the case and retrieved loss of profit in a considerable amount. The case is typical in terms of disputes resulted from corporate restructuring. The parties involved are a large asset management company and a large state-owned Enterprise Group in Nanjing. The value involved is about RMB 50 Million. 

 

 

Recently, the Supreme People’s Court directed Jiangsu Higher People’s Court to conduct retrial of a case against Ding involving contract defraud, loan defraud, embezzlement, misappropriation of public funds, bribe. Attorneys at JC Master will defend the legal rights of Ding.

 

After the verdict of the case in the second instance, Ding authorized Attorneys at JC Master to file petitions on his behalf. After ten years of effort, the Supreme People’s Court ruled that Jiangsu Higher People’s Court should conduct retrial of the case. 

 

 

On 16 June 2009, the Meeting for Foreign-Oriented Legal Service in Jiangsu was held at Nanjing Parkview Dingshan Hotel. More than 100 representatives from Hong Kong Law Society, Jiangsu Bar Association and Jiangsu Sub-Council, China Council for the Promotion of International Trade attended the meeting.

 

Justin Ma, Senior Partner at JC Master and Vice President of Jiangsu Bar Association, delivered speech entitled “Developing Hand in Hand, Jointly Creating A Bright Future.” Justin Ma, in his speech, introduced to the delegation of Hong Kong lawyers the position of Jiangsu economy, the developing strategy and the investment environment of Jiangsu, compared the status of legal service industries in Jiangsu and Hong Kong, demonstrated potential fields of cooperation, and made suggestions regarding cooperation between lawyers from Jiangsu and Hong Kong. The Vice President of Hong Kong Law Society delivered speech at the meeting. Five representatives of the delegation of Hong Kong lawyers delivered speeches regarding issues such as M&A and litigation.

 

Lawyers from Jiangsu and Hong Kong discussed issues regarding the current economic situation, prospect of cooperation and etc. Justin Ma exchanged views with representatives of Hong Kong lawyers regarding potential fields of future cooperation in finance, IPO, M&A, anti-dumping, etc. 

 

 

Recently, Wende Wang, Partner at JC Master and Director of the Construction and Real Estate Committee of Jiangsu Bar Association and Attorney Yuan Lu participated in the legislative debate for Urban and Rural Areas of Jiangsu Province Planning Ordinance (Draft), which was held by the Legislative Affairs Office of Jiangsu Province. As the main speakers on behalf of the Government and the public, they provided professional advice on Urban and Rural Areas of Jiangsu Province Planning Ordinance (Draft).

 

The legislative debate is first example in the history of legislation in China. The legislative debate, which has paved the way for lawyers to play a role in politics, achieved good social effects for promoting the legislative process in Jiangsu Province.
